The following terms and conditions shall apply to all services rendered by ROAMWIFI TECHNOLOGY (HK) LIMITED, hereafter referred to as Roam eSIM, in connection with the prepaid eSIM reselling.
The following terms and conditions are provided on the Roam eSIM application. Roam eSIM may accept variant clauses only in the case of an explicit written agreement.
Roam eSIM sells prepaid eSIMs. The customer registers and buys eSIMs on the website (https://esimroam.com) and/or Roam eSIM App. Our payments are operated by PAYPAL (https://paypal.com) and Stripe (https://stripe.com).
The customer must accept the general terms and conditions to use Roam eSIM services. The client gives directly, or by the intermediary of the service provider, on the web browser under https://esimroam.com the following information: First Name/ Last Name /Address (billing address) /Email address.
Roam eSIM shall use reasonable endeavors to provide Customer quality of service. However, Roam eSIM does not guarantee that the service will not be interrupted, furnished on due time, safe or fault-free.
Under the following circumstances, should you be unable to get connected using Roam eSIM or the data connection service does not meet expectations, Roam eSIM will not be liable for compensation of losses or breach of contract. The circumstances include but are not limited to the following:
2.3.1. Data transmission interruption due to malfunctioning of the computer rooms or communication networks of telecom carriers;
2.3.2. Data plan interruption due to force majeure events such as typhoons, earthquakes, power outages, floods, wars, or terrorist attacks;
2.3.3. System interruption due to hacking;
2.3.4. Your terminal device is faulty;
2.3.5. Remote areas that are without signals, or certain regions and environments where the signal coverage of the local carriers is lacking;
2.3.6. Areas with no network coverage, such as subways, tunnels, basements, mountain areas, and seas.
In using the Equipment or Services provided by Roam eSIM, the Customer must not engage in any action: that is abusive, illegal, or fraudulent; that causes the Network to be impaired or damaged; When the Customer is in breach of its obligations under this Sec. 2.4, Roam eSIM may suspend the Customer’s use of the Service. Roam eSIM will notify the Customer as soon as reasonably practicable of the suspension. During any period of suspension, the Customer shall continue to pay all Charges due under this Agreement in respect of the suspended Services.
The service contract between Roam eSIM and the customer starts upon completing an order at Roam eSIM's website https://esimroam.com or via the app. The contract will be terminated as soon as the customer receives the purchased eSIM. The Activation of the eSIM and acknowledgment of the Activation Policy is the Customer’s responsibility.
The payment of Roam eSIM services is made by Credit Card and PAYPAL. The currency of payment is in US Dollars($). The credit card transaction will be processed and secured by Roam eSIM providers PAYPAL (https://paypal.com) and Stripe (https://stripe.com).
4.2.1. Roam eSIM states all Charges inclusive of VAT, unless specified otherwise.
4.2.2 If the customer reasonably and in good faith disputes an invoice or part of it, the Customer shall notify Roam eSIM of such dispute within 12 days of receipt of the invoice, providing details of why the invoiced amount is incorrect and, if possible, how much the customer considers is due.
4.2.3. The customer shall not be entitled to set off any of its claims against claims of Roam eSIM, except where the customer’s claims are undisputed or have been confirmed by final court judgment.
The customer will immediately see the purchased eSIM under the “Order” tab of Personal Center on the website and/or the app.
The customer has the right to ask for a refund only if the eSIM cannot be installed and used due to a technical problem originating from Roam eSIM. To apply for a refund, please contact customer service.
In the case of abuse, misuse, depletion, waste, or other unreasonable use of data that adversely affects the network experience of other users, operators may control or stop the wrong users under the Fair Use Policy to ensure that data services are provided to all users correctly.
The eSIM data plans from Roam eSIM are offered as-is and no further modifications or customization can be made based on individual requests once purchased.
Roam eSIM is not responsible for detriments arising as a result, that the proposed service is not or not constantly available. Roam eSIM provides no guarantee of constant availability of the network service. If you have any requests, please contact customer service.
Regarding related disputes arising from the customer's use of Roam eSIM, Roam eSIM will do its best to negotiate and resolve them. If the negotiation fails, the customer agrees to submit the dispute to the China International Economic and Trade Arbitration Commission for settlement, and Chinese law shall apply.
